The undeletable duplicate folder does not have anything in it. I will carry out some in depth tests on an empty drive (if I can find one) and get back to you.
I have occasionally seen this issue on windows in some other situations & it seems to be due to some windows bug which shows a deleted empty folder in windows explorer but it is not actually there so if you again try to delete it you get an error. Try rebooting your pc to see if it makes such folder disappear as usual.
